IDEA Fairness Restoration Act



Synopsis of Act:

· IDEA Fairness Restoration Act (S. 613/H.R. 1208)


  • Legislation would all parents to recover expert witness fee in action under the Individuals with Disabilities Education Act (IDEA)
  • Would overturn previous Supreme Court decision stating that parents of a disabled child, who prevailed in an action against the school district, could not recover fees for the services of an educational consultant who assisted them during proceedings

History of IDEA Fairness Restoration Act:

*The IDEA Fairness Restoration Act, S. 613, is introduced by Senator Tom Hankin (IA) on March 17, 2011. The bill is referred to the Senate Committee on Health, Education, Labor, and Pensions.
*A similar bill, H.R. 1208 is introduced in the House by Rep. Chris Van Hollen (Md-8) on April 4, 2011. This bill is referred to the Subcommittee on Early Childhood, Elementary, and Secondary Education.
*To date, there has been no further legislative action to enact these bills in congress.
